Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of FillCue ("we," "us," or "our"). By accessing or using FillCue, you agree to be bound by these Terms. If you do not agree, do not use the service.

Service Description

FillCue is a substitute-finding platform for professional industries. Users create events with coverage needs, build ranked lists of trusted professional contacts, and run automated cascade outreach that sequentially contacts substitutes via email and SMS until coverage is confirmed. FillCue serves court reporters, interpreters, orchestras, photographers, and other professional fields where reliable substitute coverage is critical.

Accounts

Users create accounts to manage events and contact rosters. Contacts on your substitute list do not need FillCue accounts — they receive coverage requests via email and SMS and respond through secure, token-authenticated links. Contacts can manage their own availability and profile information through personalized links without creating an account.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Acceptable Use

You agree not to:

• Use FillCue to send spam or unsolicited messages unrelated to coverage requests
• Provide false or misleading information in event postings or contact profiles
• Attempt to gain unauthorized access to other accounts or our systems
• Interfere with or disrupt the platform or its infrastructure
• Upload contact information obtained through purchased lists, scraped databases, data brokers, or any source other than direct professional relationships
• Add contacts to your substitute list who you do not have a pre-existing professional relationship with
• Use FillCue to contact individuals for purposes unrelated to professional substitute coverage

Contact List Responsibilities

By adding contacts to your FillCue substitute list, you certify that:

• You have a pre-existing professional relationship with each contact.
• You have informed each contact that they may receive SMS and email notifications about coverage requests through FillCue.
• Each contact has consented to receive such communications, or you have a reasonable basis to believe they would welcome professional coverage inquiries from colleagues.
• You have not obtained contact information through purchased lists, scraped databases, data brokers, or any source other than direct professional relationships.

You assume sole responsibility for compliance with applicable telemarketing and communication laws, including the Telephone Consumer Protection Act (TCPA), with respect to your contact list. FillCue provides the technology platform; you are responsible for the appropriateness of the contacts you add and the communications sent on your behalf.

Contacts may opt out of FillCue communications at any time by replying STOP to any SMS or clicking the unsubscribe link in any email. Once a contact opts out, they will not receive further cascade outreach from any FillCue user, and you will be notified that the contact has been removed from active outreach.

SMS Terms

Intellectual Property

FillCue and its original content, features, and functionality are owned by FillCue and are protected by applicable intellectual property laws. You retain ownership of all data you provide to the platform, including contact profiles, event details, and organizational information.

Payment and Billing

FillCue offers the following subscription tiers:

• Free: Simulated outreach only, up to 10 contacts. No payment required.
• Individual: Annual subscription for solo freelancers. Includes 6 coverage requests per year with email notifications. Additional requests available at $7.99 each.
• Coordinator: Monthly or annual subscription for agency schedulers and team leads. Includes unlimited requests with email and SMS notifications.
• Podium: Monthly or annual subscription for organizations. Includes unlimited cascades, multiple substitute lists, and multi-user access.

Payment is processed securely by Stripe. By subscribing to a paid plan, you authorize FillCue to charge your payment method at the applicable rate. Subscriptions renew automatically unless cancelled before the renewal date.

If a payment fails, FillCue will attempt to retry the charge. If all retry attempts fail, your subscription will be cancelled and access to paid features will be revoked.

Founding Member Rates

Founding member rates are available to subscribers who sign up during the founding window (before August 31, 2026). Founding rates are locked for the lifetime of your continuous, active subscription.

If you cancel your subscription, your founding rate is not guaranteed upon resubscription. After August 31, 2026, new subscribers pay regular rates as listed on the pricing page.

Founding member rates apply to the tier and billing cycle selected at the time of initial subscription. Upgrading to a higher tier after the founding window closes will be charged at regular rates for the new tier.

Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period — you retain access to paid features until then.

Annual subscriptions: No prorated refunds are provided for unused portions of annual subscriptions. If you believe you were charged in error, contact [email protected] within 30 days of the charge.

Monthly subscriptions: No refunds are provided for partial months.

Upgrades: When upgrading from a lower tier to a higher tier mid-cycle, you will be charged a prorated amount for the remainder of your current billing period.

Downgrades: When downgrading, the new rate takes effect at the start of your next billing period.

Limitation of Liability

FillCue is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, FillCue shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Termination

Either party may terminate this agreement at any time. You may stop using FillCue and request account deletion by contacting us. We may suspend or terminate your access if you violate these Terms, with notice where practicable.

Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated terms on this page with a revised effective date. Continued use of FillCue after changes constitutes acceptance of the new Terms.
